1. Introductory provisions
1.1. The association Děti Fitness aneb sportem proti drogám (Children Fitness or Sport Against Drugs), ID No.: 27010813, with its registered office at Písková 288/17, Modřany, 143 00 Prague, an association registered in the Association Register maintained by the Municipal Court in Prague, file no. L 16118 (hereinafter referred to as the "Organizer") is the organizer of an international qualifying competition in sports dance routines in various musical styles held under the MiA Festival (hereinafter referred to as the "Competition").
1.2. These terms and conditions of the Organizer (hereinafter referred to as the "Terms and Conditions") govern, in accordance with the provisions of Section 1751(1) of Act No. 89/2021 Coll., the Civil Code, the mutual rights and obligations arising between the Organizer or external organizers of the Competition in connection with or based on the registration of a competitor for the Competition or Competitions organized by the Organizer and/or an external organizer through the Organizer's website operated at https://www.miafestival.cz (hereinafter referred to as the "website" or "web interface") between the Organizer and the contestant – a natural person (hereinafter referred to as the "Participant"). For the purposes of these Terms and Conditions, the Participant also means the Participant's legal representative and/or the Participant's coach.
1.3. Only duly registered Participants who meet the conditions required for participation in the Competition arising from these Terms and Conditions and the Competition Rules available at https://www.miafestival.cz/stranka/o-soutezich/vseobecna-pravidla (hereinafter referred to as the "Competition Rules") may participate in the Competition. By registering for the Competition on the website, the Participant confirms that they have read and agree to these Terms and Conditions and the Competition Rules before entering.
2. Registration for the Competition, conclusion of the contract
2.1. Individuals and small or large dance groups (hereinafter referred to as the "Team") may register for the Competition.
2.2. The Participant orders the Organizer's services by completing and submitting the registration form via the website https://www.miafestival.cz.
2.3. To register for the Competition, it is necessary to use the Participant's registration, which also includes the Participant's email address.
2.4. The Participant is obliged to provide true and complete information in the registration form. In the event of providing false information, the Organizer reserves the right to exclude the Participant from the Competition. The Participant is obliged to update the information provided in the registration form without undue delay in the event of any changes.
2.5. The deadline for registration for the Competition is bindingly set on the website. Applications after this date or after the capacity of a specific Competition has been filled will not be accepted.
2.6. The Participant agrees to the use of remote means of communication when concluding the contract. The costs incurred by the Participant when using remote means of communication in connection with the conclusion of the contract with the Organizer (costs of internet connection, etc.) shall be borne by each Participant.
2.7. The contract is concluded upon acceptance of the registration form by the Organizer, which is sent to the Participant by e-mail to the Participant's e-mail address, and upon payment of the price in accordance with Article 3 of these Terms and Conditions. The application is valid only after payment of the specified Entry Fee. The amount of the Entry Fee is determined by the Organizer and is listed on the official website of the Competition in the section for coaches.
3. Price and payment terms
3.1. The price of the Organizer's performance consists of the price of participation in the Competition (hereinafter referred to as the "Entry Fee").
3.2. The Entry Fee must be paid by the Participant in advance by bank transfer. The Participant is obliged to make the payment, stating the variable symbol of the payment, within 7 days of the date of acceptance of the registration form by the Organizer.
3.3. The Participant's obligation to pay the price is fulfilled by crediting the Entry Fee to the Organizer's account.
3.4. The Organizer shall inform the Participant of the payment of the Entry Fee by sending an electronic message to the email address provided by the Participant or the customer in the registration form.
4. Conditions of participation
4.1. The Participant acquires the right to participate in the Competition by paying the entire Entry Fee and fulfilling the other conditions set out in the Competition Rules, which the Participant has read and understood prior to registration and which they are obliged to respect. If the Participant fails to respect and comply with these binding Competition Rules, the Organizer is not obliged to allow them to participate in the Competition.
4.2. Throughout the Competition, the Participant is obliged to respect the Organizer's instructions and the jury's decisions, which are binding for the Competition.
4.3. There is no age limit for Participants; in the case of groups, the average age of the competitors on the day of the Competition is calculated. Participants are obliged to provide truthful information about their age or the age of their charges and, if necessary, to provide proof of this.
4.4. Competition performances must comply with the rules set by the Organizer. In the event of a violation of the rules, the Team may be disqualified.
5. Competition Rules
5.1. The competition is divided into several types of competitions, disciplines, performance levels, and age categories. The exact division of categories is specified in the starting list for each specific competition.
5.2. Performance is evaluated by a professional jury, which determines the winners in each category based on a points system.
5.3. Performances must not contain inappropriate content, vulgarities, or elements that could be considered offensive.

6. Responsibility and safety
6.1. Competition participants acknowledge that they are participating at their own risk.
6.2. Each Participant is aware of the risks of damage or injury arising from participation in the Competition. The Organizer is not liable for any injuries or damage incurred during the Competition.
6.3. Each Participant declares that they are participating in the Competition voluntarily.
6.4. The Organizer reserves the right to change the date, venue, or organizational conditions of the Competition in the event of unforeseeable circumstances.
6.5. Participants are required to comply with the safety regulations and instructions of the Organizer's organizational team.
6.6. Each Participant participates in the Competition at their own risk and is solely responsible for their physical readiness and fitness.
6.7. Each Participant is required to have health insurance for the duration of the Competition in case of emergency medical treatment or hospitalization.
7. Withdrawal from participation
7.1. Participants may cancel their participation in the Competition or adjust the number of Participants in individual competition choreographies. However, this must be done by the deadline for changes to applications, which is listed on the MiA Festival website for the specific Competition.
7.2. In the event of a Participant's absence from the Competition and their proper withdrawal by the deadline for changes to applications and proper payment of the Entry Fee, the organizer will automatically generate corrective documents on the working day following the end of the Competition and return the resulting overpayment to the account from which the Entry Fee was paid.
7.3. After the deadline for changes to applications, it is no longer possible to edit applications, change the number of Participants, or cancel the entire application. In this case, the Participant acknowledges that the contract, i.e., the legal relationship established between the Participant and the Organizer on the basis of registration and payment of the price in accordance with Article 3 of these Terms and Conditions, as a contract for the use of free time provided by the Organizer on a specified date, cannot be withdrawn from pursuant to the provisions of Section 1837(j) of the Civil Code. In this case, there is no entitlement to compensation or a refund of the Entry Fee.
8. Personal Data Protection
8.1. The Participant's personal data is protected on the basis of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) and Act No. 110/2019 Coll. on the processing of personal data.
8.2. Upon registration for the Competition, the following personal data of the Participant will be processed: name and surname, residential address, e-mail address, telephone number, and delivery address (hereinafter collectively referred to as "personal data") provided in the registration form.
8.3. Based on legitimate interest, the Organizer will process the following personal data of the Participant: gender, date of birth, sports club, age.
8.4. The Participant acknowledges the processing of personal data by the Organizer for the purposes of exercising the rights and obligations under the contract, i.e. for the purposes of organizing and conducting the Competition, including recording the results of the Competition, and for the purposes of maintaining a user account.
8.5. The Participant acknowledges that they are obliged to provide their personal data (during registration, in their user account, when placing an order via the web interface) correctly and truthfully and that they are obliged to inform the Organizer of any changes to their personal data without undue delay.
8.6. By submitting the completed registration form, the Participant acknowledges the information on the processing of personal data by the Organizer, which is published and available at any time at https://www.miafestival.cz/stranka/ochrana-osobnich-udaju-gdpr.
8.7. By completing and submitting the registration form to the Organizer, each Contest Participant gives their free consent to the acquisition, use, and processing of image and sound recordings of their person, their likeness, and other expressions of a personal nature made in connection with the Contest, i.e., primarily those made before the Contest, during the Competition, and when the results of the Competition are announced, in any form and without restriction, for the purposes of marketing, advertising, and promotion of the Organizer, its activities, events, and Competitions organized by the Organizer or in cooperation with it, as well as for the purposes of marketing, advertising, and promotion of its business partners, without any claim to remuneration. The participant also gives consent to the use and distribution of video and audio recordings of their person, their likeness, and other expressions of a personal nature made in connection with the Competition and their reproductions in any form for the purpose of advertising and promoting the Organizer, including, for example, in print advertising (leaflets, brochures, posters, billboards), in electronic media (the Internet), and in audiovisual advertising spots.
9. Final provisions
9.1. These Terms and Conditions are valid and effective from March 14, 2025.
9.2. The Organizer reserves the right to change these Terms and Conditions. Changes will be published on the official website of the Competition and Participants will be informed of the changes.
9.3. Legal relationships arising in connection with or based on registration for the Competition organized by the Organizer, or disputes arising in connection with these Terms and Conditions or the Competition, shall be resolved exclusively in accordance with the applicable laws of the Czech Republic.
9.4. Each Participant has the right to out-of-court settlement of any disputes that arise as a result of or in connection with registration for the race. A prerequisite for out-of-court settlement of a dispute is an unsuccessful attempt to settle the dispute directly between the Participant and the Organizer. For these purposes, the Participant is entitled to submit a proposal for the initiation of out-of-court settlement of a consumer dispute containing the requirements specified in Section 20n of Act No. 634/1992 Coll. on Consumer Protection to the Czech Trade Inspection Authority, with its registered office in Prague 2, Štěpánská 567/15, www.coi.cz. The submission of the proposal and subsequent participation in the out-of-court dispute resolution is free of charge for the Participant, with each party bearing any costs incurred in connection with the out-of-court dispute resolution separately. A proposal for out-of-court dispute resolution may be submitted no later than one year from the date on which the Participant first asserted the claim that is the subject of the dispute with the Organizer.
